In “Blue Shield of Calif. Says ‘Ghost Network’ Action Falls Flat” (Law360, February 18, 2026), Law360 discusses Jennifer Roiz et al v Blue Shield of California and the motion to dismiss filed by Blue Shield in the ‘ghost networks’ class action.

The lawsuit, filed in November 2025 in the U.S. District Court for the Northern District of California, is against Blue Shield of California Life & Health Insurance Company, Magellan Health, Inc., Magellan Healthcare, Inc., and Human Affairs International of California.

The suit focuses on the harm caused by the insurance company’s “ghost networks” as a result of these deceptive business practices. In the complaint, multiple plaintiffs across California detail their personal or their child’s struggle to find accessible care. The lawsuit claims that Blue Shield and Magellan Health give their customers directories that are inaccurate, listing mental health professionals who are either not actually in the network, not accepting new patients or unreachable.

Jake Gardner, co-counsel with Pollock Cohen LLP partner Steve Cohen, representing the plaintiffs, told Law360, “Blue Shield and Magellan have catastrophically failed to deliver the mental and behavioral health benefits they promised their members." He continued, "Defendants' motion to dismiss is a meritless attempt to evade accountability for their unlawful, and deeply harmful, conduct."
