In “NYC Can't Force Retirees To Switch Benefits, Judge Rules” (Law 360, July 7, 2023), it was reported that New York Supreme Court Justice Lyle E. Frank issued a preliminary injunction preventing the city from requiring over 250,000 retirees to switch from traditional Medicare and supplemental insurance to a privatized Medicare Advantage plan. This decision is the fifth victory in the courts for the retirees.
